In most cases, yes — stamp duty (also known as transfer duty) applies when you buy property in WA. The amount depends on the purchase price and type of property. Some buyers, like first home buyers, may be eligible for concessions or exemptions. Your settlement agent can help calculate the correct amount and make sure it’s paid on time.
On settlement day, your settlement agent organises for the balance of the purchase price to be paid to the seller and arranges for the legal documents to be lodged with Landgate. Once this is done, the property officially changes hands, and the real estate agent will release the keys to the buyer. Your settlement agent will confirm everything is complete and let you know right away.
Commercial property settlements are generally more complex than residential transactions. In addition to the standard checks and legal requirements, commercial settlements often involve reviewing leases and tenant agreements, confirming zoning and planning approvals, and handling larger financial adjustments such as land tax and outgoings. These extra steps are crucial to protect your investment and ensure compliance with WA property laws. We manage these complexities on your behalf, so you can be confident the process is accurate, thorough, and completed on time.
The timeframe depends on how quickly probate or letters of administration are granted by the Supreme Court, as this step must be completed before the property can be transferred. Once probate is in place and all required documents are ready, the transfer process itself can usually be finalised within a few weeks. Yes. Even if there’s no real estate agent involved, property transfers between family members or related parties must still go through the legal settlement process. A licensed settlement agent is responsible for preparing and lodging the transfer documents, ensuring stamp duty is assessed correctly, and updating the property title with Landgate. Having a settlement agent protects both parties by making sure the transfer is legally valid and completed without delays or errors.
Property transfers after separation or divorce are usually carried out under a Family Court order or a binding financial agreement. Once this is in place, the settlement agent prepares and lodges the necessary documents to transfer ownership with Landgate. Even if one party is keeping the home, the transfer must still be legally registered. We handle the paperwork and guide you through the process so your property transfer is completed correctly and on time.
If you’ve changed your name after marriage, you’ll need to lodge a Change of Name application with Landgate to update your property title. This usually requires your marriage certificate as evidence of the name change. We prepare the application, check that all supporting documents are correct, and lodge it with Landgate on your behalf, so your title reflects your new legal name.
